EFFECTIVE DATE. (a) In General.--Sections 2 and 3 shall take effect on the date that the Attorney General and the Federal financial institutions regulatory agencies jointly certify to the Congress that in the preceding 5 years no federally regulated financial institution has been subject to-- (1) a consent order, settlement, deferred prosecution agreement, civil or criminal penalty for a violation of the Servicemembers Civil Relief Act; (2) a consent order, settlement, deferred prosecution agreement, civil or criminal penalty for bank fraud, wire fraud, or mail fraud relating to the origination, servicing, securitization, or sale of a mortgage product; or (3) a consent order, settlement, deferred prosecution agreement, civil or criminal penalty for unfair or deceptive acts and practices relating to the origination, servicing, securitization, or sale of a mortgage product.
