Under the Constitution, only the Congress has the power to enact laws, and only the Congress can appropriate moneys. If there is a need to rescind or to repeal or to modify, why does the legislative branch not do that? Why turn that over to some unelected bureaucrat-- and this is no disparagement of bureaucrats, because we have to have them--why turn that over to an unelected bureaucrat, who is given no power under the Constitution? I am one who believes that the Congress cannot give away power that is vested in the Congress, and the Congress only, by the Constitution.
