Reclaiming my time, I must say I am very concerned about the amendment, then, because it leaves the core of the loser pay things which I am concerned about, then it adds this other whole motion to this process, and I think there are a lot of questions that bubble around in my head. I realize you cannot make this motion until 90 days after it has been filed, but what if discovery is not done? Can you keep filing this motion? Then also I think it is also one way. The defendants do not have a way to fight back if the plaintiffs start throwing out frivolous countercomplaints, or whatever, that they could possibly be doing or frivolous defenses that are raised. So I think you are giving the hammer to only one side, you are throwing attorneys into it. I do not know how many times you could be making this motion after the 90 days, and I can also see attorneys saying if you have made the motion in the first 90 days and the judge did not rule it was frivolous, then they might say you could not apply loser pays later on. I just think there are a whole lot of real confusing things here that I do not understand.
