“Let me just answer what the gentleman said. Reclaiming my time, I think it is very important to point out that it sounds so simple, but we are creating a whole new motion. There is rule 11, there is a process that is already there. We are adding something all new and that is also holding the attorney accountable, and there is a lot of discretion in there as to what a judge might hold frivolous, and we do not know how many times this motion can be made after 90 days. It could become a harassment motion. Plus you do not have anything on the plaintiff's side that is equal. So you just keep giving more and more hammers to one side and I do not think it levels the playing field at all. Mr. Chairman, I would urge Members to please vote against this amendment, because I really think the way it is written now, it is going to just cause more problems.”
