The legislation before us amends the apportionment formula for the Congestion Mitigation and Air Quality, CMAQ, program to include non-attainment and maintenance areas for fine particulate matter, so- called PM 2.5, and to make adjustments for the new 8-hour ozone standard. It does not amend the formula, however, to include non- attainment and maintenance areas for PM-10 particulate matter. Would the senior Senator from Oklahoma be willing to explore the question of whether the CMAQ apportionment formula should include factors for this Federal air quality standard as well?
