It's regrettable that the president has directed Jay Clayton not to appear at his confirmation hearing today. Mr. Clayton is a patriot and a highly qualified nominee, as the president has said repeatedly.
At a minimum, CFIUS should impose binding conditions that end China-based access to American data and require independent audits.
If the review confirms the risk, CFIUS should seek the company’s divestment of the Chinese stakes, as it did with StayNTouch and PatientsLikeMe.
But Chinese-owned 3PLs make a business out of helping their clients evade them through transshipment, undervaluation, and ghost importers of record, then undercut domestic firms with the savings.
