All he is saying is that in this ruling the State law will apply as long as it is consistent with Federal law. To do anything else, to issue a rule of any other kind, gives the States carte blanche over all unreserved Federal land. They will decide what a right-of-way is. They will decide which ones they want to build roads on. Finally, ``The agency will make recommendations on the above-described issues to the Secretary, and the Secretary will approve or disapprove of those recommendations.''
