I simply ask the question, as a Senator, would you ever consent to have confidential memoranda prepared for you by a lawyer who happened to be in your employ, who is subsequently nominated for a judicial position--would you ever consent to a wholesale turnover of all that work product prepared for you as a U.S. Senator?
