It seems to me that--well, I could see that that would be a theory. Is that the theory that Marshall and Brennan used when they consistently dissented in every death penalty case, asserting that the death penalty violates the Eighth Amendment prohibition on cruel and unusual punishment?

I've not so jokingly said, for years, Congress will pass anything on immigration, as long as it doesn't work.
This is the biggest breach of that relationship I've seen in my 40 years of law enforcement.
I don't think that statement needs modifying, but it's obviously in context that the President of the United States clearly has a constitutional power to execute pardons.
I would appreciate it, if I have misspoken in any way, I'll try to correct that.
