this is a very simple issue. We have ongoing litigation in the courts. There are hearings being held. There is discovery being conducted. And most of us who have conservative impulses on both sides of the aisle think the Constitution means something and the separation of powers means something, and the courts ought to finish their process. For the executive branch to come in and take a side in this dispute is disrespectful to the balance of power in the Constitution. There is a dispute that is going on that may have merit on both sides, but let the litigation play itself out. If this can happen in this instance, there is no possible controversy involving the Army Corps of Engineers where there is not a possibility of the executive branch inserting itself in the judicial. That is why I stand in strong opposition to the Deal amendment today, and I urge my colleagues to follow course.
