The Clerk read as follows: Mr. Loebsack moves to recommit the bill H.R. 1217 to the Committee on Energy and Commerce with instructions to report the same to the House forthwith with the following amendment: Strike all after the enacting clause and insert the following: SECTION 1. PRESERVING PREVENTION AND PUBLIC HEALTH FUND FOR ACTIVITIES FOR SENIORS, SUBJECT TO AVAILABILITY OF APPROPRIATIONS. (a) In General.--Section 4002 of the Patient Protection and Affordable Care Act is amended-- (1) in subsection (a), by striking ``It is the purpose'' and inserting ``Subject to subsection (c), it is the purpose''; (2) in subsection (b), by striking ``, and appropriated''; and (3) in subsection (c)-- (A) by striking ``shall'' and inserting ``may, to the extent and in the amounts made available for use by an appropriations Act,''; and (B) by striking ``for prevention, wellness, and public health activities including'' and all that follows through the period at the end and inserting ``for prevention, wellness, and public health activities for individuals 65 years of age or older.''. (b) Rescission of Unobligated Funds.--Of the funds appropriated by such section 4002 before the date of the enactment of this Act, the unobligated balance is rescinded.
