We just heard that a sixth grader could see that this is unconstitutional. However, a Harvard lawyer thought this was okay in April when it passed with only 11 dissenting votes, so to me, I believe that argument does not hold water. Tax-exempt status, Mr. Speaker, is not a constitutional right. It is not a constitutional right, but there is still robust due process protection in this bill that we worked out with our Democratic colleagues before passage in the Ways and Means Committee. That didn't stop, though, the gentleman from Maryland from voting in favor of these same exact identical provisions earlier this year. Mr. Speaker, I yield such time as he may consume to the gentleman from Pennsylvania (Mr. Smucker).
